CRIBoard App Terms of Use
These terms are for the CRIBoard app for iPhone and iPad. They do not cover the website at criboard.com. Using the website? See the CRIBoard Website Terms of Use.
The short version:
- CRIBoard is a scoreboard for playing cribbage. Use it for fun, and use it fairly.
- Some extras cost money. Apple handles every payment, and Apple's refund rules apply.
- Subscriptions renew by themselves until you cancel them in your Apple account settings.
- The app is provided as is. Keep track of anything that matters, like wagers, yourself.
Agreement
These Terms of Use ("Terms") are an agreement between you and Essare LLC ("we", "us") about your use of the CRIBoard app (the "App").
By downloading or using the App, you agree to these Terms and to our App Privacy Policy.
If you don't agree, please don't use the App.
Apple's standard license
The App is licensed to you, not sold, under Apple's Licensed Application End User License Agreement (the "Standard EULA").
These Terms add to the Standard EULA.
If the two conflict, the Standard EULA controls, except where these Terms give you more rights.
Using the App
You may use the App on any Apple device you own or control, as allowed by the App Store's usage rules.
You agree not to:
- Copy, change, or redistribute the App, or try to extract its source code, except as the law allows.
- Get around the App's purchase checks or unlock paid extras without paying.
- Use the App in a way that breaks the law.
Paid extras
The App is free to download.
Some extras, such as more than two players, shorter games, custom player names and colors, saved players and the score card, the crib tag that shows who deals, and extra board themes, require a purchase.
Prices and what each purchase includes are shown in the App before you buy.
Payment
All purchases are made through Apple's App Store with your Apple Account.
Payment is charged to your Apple Account when you confirm the purchase.
We never see or store your payment details.
Subscriptions
If you buy a subscription:
- It renews automatically for the same length and price unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
- You can manage or cancel your subscription in your Apple Account settings at any time. Canceling stops future renewals. You keep access until the end of the period you already paid for.
- If a free trial is offered, any unused part of it ends when you buy a subscription.
- If a price goes up, Apple will tell you beforehand and, where required, ask you to agree to it.
Restoring purchases
If you reinstall the App or use a new device signed in to the same Apple Account, tap Restore Purchases in the App's Settings to get your extras back.
Refunds
Refunds are handled by Apple under its policies.
You can ask for one at reportaproblem.apple.com.
We can't issue refunds ourselves.
Changes to paid extras
We may add, change, or remove features, and change prices for future purchases.
If we remove an extra you paid for once, we will try to give you something of similar value.
Third-party services
The App uses Superwall to show offers for paid extras and to check what you have unlocked.
Apple processes all payments.
Your use of those services is also covered by their own terms and privacy policies.
We are not responsible for services we don't control.
Ownership
The App, its design, artwork, logo, and the CRIBoard name belong to us or our licensors.
The Fredoka typeface is used under the SIL Open Font License.
The rules of cribbage belong to everyone.
Scores and wagers
CRIBoard keeps score for you, but it can't check that the points entered are right.
Don't rely on the App alone to settle anything that matters, such as a wager or a tournament result.
Disclaimer
To the fullest extent the law allows, the App is provided "as is" and "as available", without warranties of any kind, express or implied.
We don't promise that the App will always be available, free of errors, or keep your game data forever.
Some places don't allow these exclusions, so some of them may not apply to you.
Limit of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages, or for lost data, arising from your use of the App.
Our total liability for any claim about the App is limited to the amount you paid for it in the 12 months before the claim.
Nothing in these Terms limits liability that can't be limited by law.
Ending these Terms
You can stop using the App at any time by deleting it.
If you break these Terms, your right to use the App ends.
Ending these Terms does not cancel a subscription. Cancel it in your Apple Account settings.
Governing law
These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict of law rules, except where the law of your country of residence requires otherwise.
Changes to these Terms
If we change these Terms, we will post the new version here and update the date at the top.
If you keep using the App after a change, you accept the new Terms.
